Terms of Service

You become a Member by creating an account on the Platform and accepting these Terms. You sign in with your email address (or a supported sign-in provider). You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

By creating an account, accepting these Terms, or continuing to use the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

The Platform is intended for persons located in the United States who are at least twenty-one (21) years old (or the legal wagering age where they reside, if higher) and who can legally enter into these Terms. Use of the Platform is at your own risk, and you must comply with all applicable laws, rules and regulations. We may limit availability of the Platform, in whole or in part, to any person, geographic area or jurisdiction at any time.

The Platform provides informational and entertainment content about sports, including commentary, analysis, picks and predictions (the "Content"). All Content reflects opinions and does not constitute financial, investment, legal or betting advice, or a recommendation to engage in any sports betting, fantasy sports or gaming activity.

NickyCa$hin is not a sportsbook. We do not accept, place, transmit or settle bets or wagers, and we do not facilitate real-money gambling. Any wagering you undertake with a third-party sportsbook is at your sole risk and discretion. We assume no responsibility for any losses resulting from your reliance on Content available through the Platform. No result is guaranteed; past performance does not predict future results.

Access to picks requires an active paid membership. We currently offer the NickyCashin VIP monthly membership and the Nicky Elite Football Package annual membership. Features and pricing for each plan are shown at checkout and may change from time to time; price changes never apply retroactively to a period you have already paid for.

Auto-renewal. Monthly and yearly plans automatically renew at the end of each subscription period at the then-current price, until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis.

Cancellation. You may cancel at any time from your Account page. Cancellation stops future renewals immediately. You keep access to the plays and pick alerts through the end of the period you have already paid for, after which access ends and you are removed from pick notifications. You may resume your membership at any time.

Plan changes. If you switch between recurring plans while your membership is active, the change takes effect at your next renewal date. You keep the plan you already paid for until then.

Failed payments. If a renewal payment fails, access may be suspended or terminated until payment succeeds.

Payments are processed by Whop. We do not store your full card details. All amounts are billed and charged in USD and are exclusive of any applicable sales or transaction-based taxes, which are your responsibility. The total amount due is displayed before you complete payment.

You agree to pay for the Platform only through the payment channels we authorize. Your use of Whop is also subject to Whop's own terms.

All sales are final and non-refundable. This includes partial periods, unused time, and periods during which you did not view Content. Cancelling stops future charges but does not refund amounts already paid, except where a refund is required by applicable law.

When picks are published, we may email you at the address on your account. You consent to receive these transactional and pick-alert messages as part of your membership. You can stop them by cancelling your membership or contacting support. If we offer SMS alerts, message and data rates may apply and you may opt out at any time.

We own all proprietary rights in the Platform and its Content, including trademarks, service marks, trade secrets, copyrights and other intellectual property rights. The NickyCa$hin name and logo may not be used in connection with any product or service that is not ours, or in any manner likely to cause confusion, without our prior written consent.

Content delivered to Members is proprietary and confidential and is licensed for your personal use only. Sharing, reselling, screenshotting for distribution, posting, or otherwise redistributing picks or analysis to any third party — electronically, verbally or in writing — is strictly prohibited. Any Member found sharing Content externally may be immediately and permanently banned at our discretion, without refund.

You agree not to:

• share, resell, or redistribute Content, or share your account credentials;
• post or transmit content that is unlawful, infringing, fraudulent, defamatory, obscene, harassing, hateful, threatening, or that promotes violence or illegal activity;
• access non-public areas of the Platform, probe or test its security, or circumvent any technical protection measures;
• scrape, crawl, mine or otherwise automate access to the Platform or its Content;
• send spam or unsolicited advertising to Members;
• reverse engineer, decompile or disassemble any part of the Platform;
• interfere with the Platform or any Member's access to it, including by flooding or transmitting malicious code;
• impersonate any person or misrepresent your affiliation with any entity; or
• encourage or enable anyone else to do any of the above.

We may monitor use of the Platform, remove Content, and suspend or permanently terminate accounts that violate these Terms, without refund.

If you believe Content on the Platform infringes your copyright, email us at support@nickycashin.com with: your contact information; identification of the copyrighted work; a description and location of the allegedly infringing material; a statement that you have a good faith belief the use is unauthorized, that your notice is accurate, and — under penalty of perjury — that you are the owner or authorized to act on the owner's behalf; and your electronic or physical signature. We may remove infringing Content and terminate repeat infringers without refund.

We value your privacy. We collect and use account, billing and usage information to operate the Platform, process payments and deliver picks. We do not sell your personal information. Questions about privacy can be sent to support@nickycashin.com.

The Platform and all Content are provided "as is," without warranty of any kind. We explicitly disclaim any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement. We make no warranty that the Platform will meet your expectations or be available uninterrupted, secure or error-free, and no warranty regarding the quality, accuracy, timeliness, truthfulness or completeness of any Content or pick. Your use of the Platform and any decisions you make based on it are at your sole risk.

To the maximum extent permitted by law, NickyCa$hin and its service providers will not be liable for any incidental, special, exemplary or consequential damages, or for lost profits, lost revenues, lost savings, gambling losses, loss of data or goodwill, service interruption, or the cost of substitute services, arising out of or in connection with these Terms or your use of or inability to use the Platform, under any legal theory, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability arising out of or in connection with these Terms will not exceed the fees you paid to us during the six (6) month period preceding the event giving rise to the liability.

You will indemnify and hold harmless NickyCa$hin and its owners, officers, employees and agents from and against any third-party claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) related to or arising from your access to or use of the Platform or your violation of these Terms.

You or NickyCa$hin may terminate these Terms at any time. You may terminate by cancelling your membership and closing your account; we may terminate by giving notice or discontinuing the Platform. On termination your right to use the Platform ends immediately, and any provision that by its nature should survive termination will survive. You remain responsible for all amounts accrued before termination.

We may update these Terms from time to time at our sole discretion. If we do, we will post the updated Terms on the Platform. Continued use after the effective date means you accept the updates. We may also change or discontinue any part of the Platform at any time.

The Platform may link to third-party websites or resources, including sportsbooks. We do not control or endorse them and are not responsible for their content, products, services, privacy practices or security. Your use of any third-party site is at your own risk.

These Terms are the entire agreement between you and NickyCa$hin regarding the Platform and supersede all prior understandings. If any provision is held invalid, it will be enforced to the maximum extent permissible and the remaining provisions stay in effect. You may not assign these Terms without our written consent; we may assign freely. Our failure to enforce a provision is not a waiver of it.

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any controversy or claim arising out of or relating to these Terms will be resolved by binding arbitration, and you and NickyCa$hin waive the right to participate in a class action.
